Alan Gelb – Senior Partner conducting broad based commercial litigating practice for over 50 years in both federal and state courts, commercial and international arbitration, providing counsel, lead trial and appellate services. Principal substantive areas involved include real estate, securities, banking, accounting and related services, defamation and domestic relations matters. Alan’s practice commenced with Amen, Weisman & Butler, a highly respected boutique firm, and continued as a member of Finley, Kumble, Wagner, Heine, Underberg, Manley & Casey and successor entities; and Jones, Hirsch, Connors & Bull. He has represented major institutional entities in all phases of civil litigation from inception, through trial and appeal, and provided services as counsel in related business and commercial settings.

Real estate matters included representing major food retailer in securing NY Court of Appeals order holding that percentage rent lease did not imply a covenant limiting client’s right to assign lease to a major supermarket operator and granting judgment in favor of client.

Tried action in SDNY for fraud by regional developer in connection with joint venture to construct and operate upstate shopping center. Secured final judgment reducing mortgage loan burdening client’s joint venture interest, declaring due on sale provision of mortgage unenforceable; requiring defendant to account for and return funds and recovered legal fees and punitive damages against JV partner and institutional lender.

General litigation defense of multiple actions for auditor and accounting liability.

Defended action in SDNY by former foreign representative of defense contractor seeking commissions in connection with contract for sales of underwater sonar for NATO submarines.

Trial of claims before International Court of Arbitration against defense contractor arising out of sale of wireless communication system for five states in Eastern Nigeria.

Defense of multiple NASD Customer Arbitration Claims.
