CASTAYBERT PLLC is experienced in bankruptcy and creditor litigation.  The firm’s principal attorney has represented creditors filing claims in bankruptcy and has litigated applications to lift the automatic stay.  He has also represented companies and executives in adversary proceedings involving claims of preference, fraudulent conveyance, and claims fraud.  He is fully familiar with the different discovery devices and hearing procedures in bankruptcy.  His experience includes the representation of a major American bank, in complex bankruptcy proceedings in Delaware, arising out of the collapse of a student loan financing company.  He has also represented a major French telecommunications company in a variety of motions in the context of complex bankruptcy.  Among the matters that he has litigated in bankruptcy proceedings are breaches of warranty or representations; contracts and lease disputes; jurisdictional disputes; the appointment of receivers and trustees; fraudulent transfers; and fraud and breach of fiduciary duty against officers and directors.
